What are punitive damages in a trucking accident case? Punitive damages are damages that are given to a plaintiff by a jury to punish the truck or the trucking company based upon gross negligence. How do you prove gross negligence? If you find yourself to be the victim of a trucking accident case and you find out that the trucking company hired a truck driver with a drug or alcohol problem, and the driver was involved in several collisions before while high, and they kept him or her on as a truck driver. In those situations, you may be entitled to not only compensatory damages, which are damages for your pain, suffering, loss, wages, and medical expenses, but you also may be entitled to punitive damages to punish the trucking company for allowing a truck driver on the road who has no business being there.
